What personal data do we collect about you?

  1. Technical data

When visiting our website, we collect technical data, which your browser transfers automatically (in particular your IP-Address, time of access, requested websites/data, referrer URL, operating system and product and version information of the browser used) (“technical data”).

  1. Registration data for your user account

By creating a Bordelle account; we collect some personal data which you provide us with, such as your name, email address, billing and shipping address (“account data”). You also have the option to save your telephone numbers and review your past orders and deliveries. Upon registration and placing your first order, we will collect your telephone numbers and addresses and review your past orders and deliveries and add these data to your user account.

  1. Order data

By placing an order with our online shop, we collect some personal data which you provide us with. Such as your name, email address, telephone numbers and shipping and billing addresses. Furthermore, we collect your order number, details of the purchased goods (e.g. item title, size, colour, purchase price, etc.), payment method, notifications and communications regarding purchases (e.g., revocation notices, complaints, and notifications to customer service), delivery and payment status, return status, details of service providers involved in the execution of the contract (e.g. tracking numbers of our nominated couriers such as DHL, UPS and Fan Courier) ( “order data”).

We offer you various common payment methods in e-commerce, in particular credit/debit card and wire transfer. For the execution of payments, we collect the payment data provided by you. We receive further payment data from external payment service providers and credit agencies with whom we cooperate for the execution of payments and for credit checks. We only pass on data to our payment service providers that is necessary for payment processing and for the performance of the contract concluded.

Payment data also includes other information that occurs in direct connection with payment processing and creditworthiness checks. This concerns for example, information that external payment service provider use to identify you and/or your respective user account.

Creditworthiness data consists of so-called score values that we obtain about you from external credit agencies. Creditworthiness data contains information about a person's estimated economic capacity and willingness to perform. This helps us to avoid payment defaults that occur when customers cannot meet their payment obligations on time or at all. At the same time, taking creditworthiness data into account when selecting payment methods is intended to prevent us from offering our customers payment methods that cannot be offered to you and to prevent our customers from entering into payment obligations that you yourself cannot meet. Creditworthiness data is usually determined by so-called credit agencies. These agencies use various data to calculate a so-called score value, which takes into account, among other things, existing payment obligations and any previous payment defaults. Score values are statistically based estimates of a person's future risk of default and are presented as a numerical value, such as a percentage. We have only limited influence on the data processing of external credit agencies (e.g. when we provide credit agencies with information about unfulfilled payment obligations) (hereinafter all data of this section “payment data”).

Depending on your settings and your consent towards the respective payment service provider, it may be that the provider stores and collects your payment data. The respective payment service provider may use this data to auto-complete your payment data at checkout in order to facilitate a faster checkout.

  1. Shopping interest data

We may use your personal information provided in the checkout, your shopping interest data, meaning information about what types of products you prefer, seize, colours and brands, and purchasing behaviour for our internal marketing and demographic studies (“shopping data”).

  1. Data for our Newsletter

When you register to our Newsletter, we collect your email address, name, location and your technical data. By subscribing to our newsletter you will receive email alerts for new products, collections, features, sample sales, special offers, contests, events of interest, and promotions.

Please note that we may track and evaluate your user behaviour when sending our newsletter. For this tracking and evaluation, the newsletter emails sent contain so-called web beacons or tracking pixels. These single-pixel image files are stored on our website. For the evaluations, we link the aforementioned data and the web beacons or tracking pixels with your e-mail address and an individual ID. Links contained in the newsletter also contain this ID. The data is collected exclusively pseudonymously, meaning the IDs are not linked with your other personal data, so that a direct personal reference is excluded.

For what purposes do we process your personal data?

  1. We process your technical data solely for the purpose to provide you the website, to ensure the security and functionality of the website, as well as for the evaluation of the use of the website (Art. 6 (1) lit. f GDPR).

We process account data solely in order to provide you with access to your personal user account with Bordelle and hence to perform the contract concluded with you (Art. 6 (1) lit. b GDPR) or for protecting our justified interests in providing our online shop to you in accordance with Art. 6 para 1 lit. f) GDPR. Optional data that you can provide when registering without ordering goods are processed based on your consent pursuant to Art. 6 (1) lit. a GDPR. Once you order goods and your order data will be connect with your account data we process your personal data in order to fulfil and perform the contract concluded with you (Art. 6 (1) lit. b GDPR)
  1. We process order data in order to execute, perform and fulfil the contract concluded with you pursuant to Art. 6 (1) lit. b GDPR. Order data is especially necessary for us to be able to dispatch your order. Additionally, the processing is necessary to protect our legitimate interest in investigating the loss of goods in transit (Art. 6 (1) lit. f GDPR).
  1. We process payment data in order to execute, perform and fulfil the contract concluded with you pursuant to Art. 6 (1) lit. b GDPR. Moreover, we process payment data and perform creditworthiness checks in order to prevent fraud and to avoid payment defaults. Basis for the performance of creditworthiness checks is also Art. 6 (1) lit. b GDPR, as it is necessary for the performance of prerequisite pre-contractual measures. Otherwise, this processing of your data is carried out on the basis of our legitimate interest in avoiding payment defaults, detecting and preventing fraud and solving crimes (Article 6 (1) lit. f GDPR).

We process you shopping data for the improvement of our site design, the extension of our range of products, to better meet our visitors’ needs and for our internal marketing and demographic studies that helps us to understand your shopping behaviour and improve our entire offer based on your individual needs. The legal basis is either our legitimate interest pursuant to Art. 6 (1) lit. f GDPR, or, where shopping data is used for profiling and offering you specific goods and services, your express prior consent pursuant to Art. 6 (1) lit. a GDPR.

We process your email address, your name you provide when registering for our newsletter, and your location for the purpose of sending you information about latest and interesting offers and on the basis of your previously given consent (Art. 6 (1) lit. a GDPR). For the registration to our newsletter we use the so called Double-Opt-In-Procedure. This means, that we will send you an email asking for your confirmation that you actually wish to receive our newsletter after your registration. The purpose of this procedure is to prove your registration and, if necessary, to investigate a potential abuse of your personal data.

With whom do we share your personal data?

When do we delete your personal data?

The newsletter data will be stored as long as you have subscribed to the newsletter.

Which rights do you have?

You have the right to request information about the data we have stored about you in accordance with Art. 15 GDPR, to request the rectification of inaccurate data in accordance with Art. 16 GDPR and to request the erasure of data in accordance with Art. 17 GDPR or the restriction of data processing in accordance with Art. 18 GDPR. Under the conditions of Art. 20 GDPR, you may also request the transmission of personal data to you or a third party. Furthermore, in accordance with Art. 21 GDPR, you have the right to object to the processing of your data, provided that the reason for the objection arises from your particular situation and it concerns data that we process to protect one of our interests worthy of protection or if it concerns the use of your data for direct marketing.

Furthermore, you have a right to lodge a complaint with a competent supervisory authority pursuant to Article 77 GDPR if you consider that we are not processing your personal data in accordance with applicable law.

Additionally, at all times, we will offer you the opportunity to unsubscribe out of any service or update to which you have subscribed, if you change your mind.
